Slip and Fall on Ice Interview
Fall down accidents are common and the injuries can be disabling. The elderly are particularly vulnerable since they may have problems with balance and with the ability to walk.
In New York, in order to recover damages, you have to prove that the fall was caused by an unreasonably dangerous condition. In the case of ice and snow, a meteorologist may be required to prove that the ice and snow had been there long enough to give the defendant the opportunity to remove the ice and snow and to apply salt. In the case of a defective stairway or sidewalk, we may need an architect or engineer to examine the stairs or sidewalk to determine if they were defective.
In a recent case, we represented an older gentleman who fell on ice and snow, suffering a serious spinal injury resulting in surgery. Our investigation revealed witnesses, including ambulance personnel, who described the icy condition. A meteorologist was retained to review the weather data. He was able to provide a report indicating that the ice and snow had been there long enough to give the defendant notice of the condition and the opportunity to remove the ice and snow and apply salt. As a result of our efforts, we were able to obtain a significant recovery for our client and compensate him for his medical bills and his resulting disability.
